Take decision on application for renewal of noc within a week: Bombay HC

Mumbai: The Bombay high court on Thursday directed the MMRDA to decide within a week the application made by a residential cooperative housing society in Juhu, seeking to renew the NOC granted to it for redevelopment. 

The MMRDA has refused to renew the NOC on grounds that the route for Metro 2B has been realigned and will go through the petitioner’s property. 

Meanwhile, the HC said that the MMRDA cannot acquire any private property without following due process of law and giving proper compensation,

A division bench of Justice Abhay Oka and Justice Riyaz Chagla was hearing the petition filed by  filed by advocate M.K. Sayed, Spenta Havewala and Rashmikant.

According to the petition, the MMRDA was attempting to alter the route to cut through and effectively dissect the said property and this act was unreasonable and illegal. 

The petitioners said that the alteration would make it impossible for them to proceed with the ongoing redevelopment of this property. 

The court was informed that the MMRDA had issued the NOC for redevelopment in March 2017, after taking into account all relevant factors, including the Metro alignment.
