A division bench of Justice V.M. Kanade and Justice Swapana Joshi was hearing an application filed by the residents of Sunita, a building, who sought stay on a high court order that directed Brihanmumbai Municipal Corporation (BMC) to demolish three floors of the building due to height regulation violations.

While hearing a PIL filed by advocate Yashawant Shenoy regarding height violations of high-rise buildings near airports on August 10, the court had ordered that three floors of Sunita be razed.

The Directorate General of Civil Aviation (DGCA) had permitted its builder, Sailee Construction, to construct the building up to 13.9 metres. However, the building’s actual height is 24.7 metres.

On Wednesday, the developer filed an application seeking a stay on the demolition order, saying that when the building was being constructed it was not aware that the height would be calculated from the runway or sea level.

The court refused to accept the contention and said the developer has misrepresented the facts before the authorities and constructed the building.

The court has posted the application for hearing on September 20 along with the two petitions on height violations around the airport.
