Woman gets bail in rape case of model after 1 year
The Bombay high court on Thursday granted bail to a woman who was arrested for allegedly abetting the rape of a model inside a police chowki in the jurisdiction of Saki Naka police station last year.
The Bombay high court on Thursday granted bail to a woman who was arrested for allegedly abetting the rape of a model inside a police chowki in the jurisdiction of Saki Naka police station last year. The woman was arrested for posing as a police constable and robbing the model of her valuables in the police chowki after she was sexually assaulted. The court granted her bail as she has already spent a year in the jail.
The woman, identified as Ayesha alias Asha Prem Narayan Malviya, was arrested along with three policemen based on the complaint of the model. According to the model, she wanted to act in Bollywood films. In November 2014, one Kavaldeep Singh contacted her through social media and told her that a businessman was ready to give her role in films and asked her to meet him in a hotel. During the meeting Singh asked her to accompany him into a room, which she refused. When she was leaving the hotel with Singh, some people came there in a Tata Safari and one of them showed his identity card and said they were policemen and asked both the persons to sit in the car.
Thereafter they were first taken to Saki Naka police station where Ayesha also met them. Later Ayesha along with other policemen took the victim to Sangharsh Nagar police chowki. In that police chowki two policemen in plainclothes questioned the model if she was a prostitute. The complainant alleged that despite refusing this allegation the personnel were forcing her to confess that she was one.
At about 3 am, two policemen and Ayesha left the police chowki. There was only one policeman at the police chowki and he allegedly molested and raped her. Later Ayesha and the others came back and took away her wristwatch, her ornaments and other articles valued around Rs 4,98,000, the model said.
Ayesha’s lawyer, while seeking bail, argued before the court that the applicant is a 30-year-old woman, she is innocent, and falsely implicated in the case. No articles were recovered at her instance and she has been in prison since April 24, 2015 and hence she should be granted bail.
On the other hand, the public prosecutor opposed the plea, saying the applicant was present at the scene of the offence continuously and she also robbed the victim and the police had recovered Rs 23,000 from her.
After hearing arguments, Justice Mirdula Bhatkar observed, “Considering the role attributed to the applicant and the fact that the lady is in prison for last one year, I am inclined to grant her bail.”
