The widow and son of Mumbai hit-and-run victim Shaikh Noorulla Shafik, killed in the 2002 incident involving actor Salman Khan, on Wednesday moved the Supreme Court challenging the actor’s acquittal by the Bombay high court, saying it was a miscarriage of justice.
In a special leave petition filed through counsel Vipin Nair, widow Begumjaha Haroon Khan and her son said they should be suitably compensated as Shaikh Noorulla Shafik, killed on the spot in the accident on September 28, 2002, was the family’s sole breadwinner. The SLP sought a direction to the 50-year-old actor to pay compensation to them.
The two petitioners said the high court made a “serious error” in reversing the trial court’s order, and also claimed the courts had ignored Sections 357 and 357A CrPC that provides for compensation to victims of crime. The Maharashtra government has already challenged Salman’s acquittal.
