Granting relief to gangster Santosh Shetty, a special court in Mumbai on Tuesday revoked the Maharashtra Control of Organised Crime Act (MCOCA) from a case of kidnapping and extortion of a businessman and his son in Bangkok that was registered against him.

Shetty’s lawyer Prakash Shetty had filed for discharge from the case, and the court, after hearing arguments, was convinced that MCOCA is not applicable to the case. The gangster will now be tried for kidnapping and extortion under sections of the Indian Penal Code.

According to advocate Shetty, his client was booked in various cases and only this one had MCOCA charges, which were removed by the court, as the case was “totally false and fabricated”.

He also said that they would wait for the copy of the detailed order and, after studying it, would approach the high court for a complete discharge from the case. The prosecution’s case is that Shetty had allegedly promised a huge loan to a businessman and his son on low interest for their business. The complainant was assured that the loan would be arranged from a financial company either from Bangkok or London.

In September 2010, allegedly, the complainant and his son went to Bangkok to meet Shetty but they were allegedly beaten up and '15 crore was demanded from the complainant’s family for their release. The complaint was registered two years later.
