The special CBI court recently rejected the bail application filed by Indrani Mukerjea, prime accused in the sensational Sheena Bora murder case and as per the detailed order the judge while rejecting her bail plea also took into consideration that though the bail plea is filed on medical grounds, there is no immediate threat to her life.
“On going through factual position revealed from the case history as well as reports from medical officer of Sir JJ Hospital, Mumbai, medical officer attached to the jail and private doctor i.e. Dr Arun Shah, it reveals that, no one amongst them pointed out immediate threat to the life of the applicant,” read the order passed by special judge H.S. Mahajan.
The judge also observed, “It cannot be overlooked that, standard of living of the applicant prior to the incident plays a vital role as now inside the jail she is not getting all the luxurious facilities. It is also important to note that she is now behind bars for commission of murder of her real daughter. Certainly, her psychological condition might have initially affected. It may cause such suffering such as, weight loss, fluctuation of blood pressure etc. However, fact remains that, best available treatment is being given to the applicant, that too from the experts of Sir JJ Hospital in Mumbai.”
The judge, however, said that Indrani could be granted a special medical check-up by a specialist. “Moreover, so as to avoid possibility of incorrect diagnosis and to remove doubt in the mind of the applicant, in that behalf suitable arrangement can also be made so that the applicant can get proper treatment in a private hospital. Further, if required suitable arrangement also can be made for treating the applicant in a private medical hospital that too indoor and outdoor treatment by imposing certain conditions,” said the judge.
