The Bombay high court on Tuesday granted actor Salman Khan two more week’s time to furnish sureties. The actor was acquitted by the high court in the 2002 hit-and-run case but as per law the acquitted accused also needs to furnish sureties to ensure he would be available to face the prosecution in case the state files an appeal against the acquittal.
Justice A.M. Thipsay after hearing arguments on Tuesday permitted the actor two more weeks to complete the formalities and submit the sureties.
On December 10, Justice A.R. Joshi of the high court had acquitted Khan and quashed and set aside the trial court’s order convicting the actor and sentencing him to five years in jail, for allegedly driving his car under the influence of alcohol and running over people sleeping on the footpath in suburban Bandra in 2002.
As per Government Resolution (GR), if any accused is acquitted from a criminal case he is asked to furnish bail bond so that he is available to face the prosecution in case the judgment of acquittal is challenged in a higher court. This bail bond remains in place for the period under which government is supposed to file an appeal.
Khan was convicted by the trial court for culpable homicide not amounting to murder in the 2002 hit-and-run case in which one person had died and four others were injured.
The actor had appealed against his conviction and the high court allowed the appeal and acquitted Khan.
Justice Joshi, while acquitting the actor, directed him to submit two sureties worth Rs 25,000 each, as per section 437-A of the CrPC. The sureties had to be submitted within two weeks.
When it could not be arranged, the actor approached the high court seeking more time, saying certain formalities are not yet over.
