Dissatisfied with the investigation done so far into the murders of rationalists Narendra Dabholkar and Govind Pansare, the kin of the deceased on Monday requested the Bombay high court to hand over the probe to the National Investigation Agency. However, the court has turned down the plea. Meanwhile, the CBI informed the court that the agency is considering going for a third opinion on the weapon used in the murders because there are contradictory reports from Kalina and Bangalore FSLs.
Advocate Abhay Nevgi, appearing for the kin of Dabholkar and Pansare who petitioned the high court seeking setting up of an independent investigation team to probe the murders, requested the bench to transfer the investigation to the NIA. The division bench headed by Justice R.V. More , however, noted that the CBI is in touch with NIA and hence there is no need to hand over probe to the latter at this stage.
Meanwhile, additional solicitor general Anil Singh on Monday informed the bench that as per Kalina forensic lab the same weapon had been used to kill Dabholkar, CPI leader Pansare and rationalist M.M. Kalburgi. However according to the Bangalore forensic lab, different weapons were used to shoot these persons.
In the current scenario the CBI is considering going for a third opinion to know about the weapon used in the killings.
Mr Singh also sought two months time to get third opinion saying the CBI wanted an opinion from Scotland Yard police laboratory.
However, the judges said they cannot grant such a long period after which ASG told the court that an opinion could be sought from Delhi FSL also.
The CBI is probing the Dabholkar murder case while an SIT of state CID is investigating the murder of Pansare. Both the agencies filed status report before the court. The bench, after perusing it, said the investigation is at a crucial stage and both the agencies are making sincere efforts.
