The Bombay high court on Wednesday directed the state government to prepare selection lists for the admission of students in private unaided medical colleges in the state.

The Bombay high court on Wednesday directed the state government to prepare selection lists for the admission of students in private unaided medical colleges in the state. The court directed the state to prepare two lists, one according to NEET (National Eligibility cum Entrance Test) and another as per government rules. However, it restricted the state from publishing it without the final order of this court.

A division bench of Chief Justice Manjula Chellur and Justice M.S. Sonak was hearing a petition filed by Mahatma Gandhi Vidya Mandir, a trust that runs a dental college in Nashik. The trust challenged the admission clause of Maharashtra Unaided Private professional Educational (Regulation of Admissions and Fees) Institutions Act, 2015, which does not allow outside students to apply to private medical institutes in Maharashtra.

On September 3, the high court had stayed the admission process and selection list, which the state was going to publish.

On Wednesday, senior counsel Shreehari Aney who appeared for the state, said to the court that the state has brought this rule for the benefit of the students who reside in Maharashtra. And this rule has been brought into effect this year. He further added that the domicile position could be included in the rules.

During the hearing, the court came to know that the state has not cleared the domicile criteria in its new rule. Therefore, it has asked the government to explain in clear terms what they meant by domicile. Parents and students should not be in a dilemma as to what is domicile, the court said. It also asked the criterion for the admission.

The petitioner will start arguments from Thursday on the rules imposing restrictions on students from outside the state.
