The lawyer of Abu Jundal, accused in the Mumbai terror attacks case, has written letters to the State Human Rights Commission as well as to the Chief Justice of the Bombay high court complaining that the authorities at the Arthur Road jail are not allowing him to meet Jundal, which is in violation of the rights of the accused and the principles of natural justice.
In a letter dated September 10, advocate Asif Naqvi has said that he has been denied permission time and again to meet Jundal. He has mentioned one such incident that took place on August 13, when he was first made to wait for three hours and, after he went up to the second entrance, was later sent back without being allowed to meet him.
“I am now waiting for appropriate action from the authorities concerned,” advocate Naqvi told The Asian Age.
According to the letter, advocate Naqvi reached the Arthur Road jail around 1 pm on August 13 and was made to wait till 3 pm. He was then allowed to enter the gate but, at the second entrance, he was asked to meet a certain officer (whose name is not mentioned in the letter) who asked him to produce the court order or permission allowing him to meet Jundal since, according to that particular officer, some other lawyer was representing Jundal.
This, advocate Naqvi said, was despite the fact that he has been representing Jundal since 2013.
“The jail authorities are purposely not allowing the accused to meet his advocate and this is a denial of the right to fair trial, equity and natural justice,” said the letter, adding that on September 9, the lawyer had once again received a letter from Jundal asking him to meet him in jail.
