‘No need to file one more FIR in encounter case’
Observing that there was no need to file an additional FIR when a complaint was already lodged and the investigation was on to find out if suspected gangster Sandeep Gadoli’s encounter was genuine or not, the Bombay high court on Wednesday dismissed the petition filed by the brother of the deceased. Gadoli was shot dead by Gurgaon police at a hotel in Mumbai and his family is claiming that the encounter was staged.
Kuldeep Singh, the brother of the deceased, had moved the petition through advocate Tanveer Nizam and Yusuf Khan requesting the court to direct the police to register an FIR against policemen who were involved in Gadoli’s encounter. They had contended that the encounter was done at the behest of Gadoli’s business rival and Binder Gujjar, a politician from Gurgaon.
They also claimed that though the police had registered an FIR, it was against the deceased and hence there should be another FIR against policemen to investigate the staged encounter.
One of the points in their application also challenged Gadoli’s post-mortem report claiming that it was prepared favouring the police.
On the other hand, Attorney General Mukul Rohatgi, on behalf of the Haryana police, argued before the court that the police had already filed an FIR and the investigation was on to determine if the encounter was fake or not. He also said that the registration of multiple FIRs in one case would only lead to chaos and clutter.
