A case of negligence has been registered against a minor who died on Wednesday after a sedan fell off a car lift shaft in a Madanpura highrise in South Mumbai. His driver too was killed in the accident.

The deceased, Hafeez Patel (14) and his family driver, Javed Ahmed Shaikh (26) were practising driving when the accident occurred.

Hafeez’s father, Ayub Patel, said, “I was unaware about the keys of the car that were taken from home by our driver. I didn’t know when he took the keys and started teaching driving to my son. His mother was there at home but she also didn’t know about the same. After a long time when he didn’t come back home, his mother called me and we started calling on his phone. A few hours later, our watchman found our car at the lift side and informed us.”

Police said, “The watchman told us that for almost two hours, he was searching for the boy after Mr Ayub asked him whether he had seen Hafeez going out of the building. He was clueless as he had not seen Hafeez stepping outside the building. We started checking CCTV footage but there too, we could not see Hafeez nor the driver. We just saw that in the morning, the driver entered the building but didn’t see him going back outside. Later, the watchman went to check Mr Ayub’s car whether it was there in parking or not. At that time, he saw the car near the lift area.”

Police said Hafeez was taking driving lessons from Mr Shaikh on the second floor of the building. They checked CCTV footage on Thursday and after that, they registered a case against the boy who was responsible for the accident.

Nagpada police station Senior Police Inspector, Shivaji Kadam, said, “Our officials’ team took all the CCTV footage of the building and scrutinised it. It was shown clearly in the CCTV camera that Hafeez was driving the car. When he was trying to take a reverse, he could not control the speed of the car and crashed it into the elevator gate and plunged it into the shaft. At the time, the elevator was on the third floor.”

The Nagpada police on Thursday evening registered a case against Hafeez under Indian Penal Code Sections 304 A and 279 for rash driving and causing death by negligence and the MV Act . The driver was also booked for responsibility of Owners of Motor Vehicles under the MV Act.
