Kidney racket: Court rejects doctors’ bail pleas

A sessions court on Friday rejected the anticipatory bail application (ABA) of two doctors from the L H Hiranandani Hospital in connection with the alleged kidney racket case.

A sessions court on Friday rejected the anticipatory bail application (ABA) of two doctors from the L H Hiranandani Hospital in connection with the alleged kidney racket case. At the hearing, the police insisted that custodial interrogation of the two doctors was required. Both doctors are likely to be arrested soon.

Dindoshi sessions court judge F.M. Khwaja rejected the pre-arrest bail applications of doctors Suwin Shetty, a pathologist, and Veena Sewlikar, a general surgeon from Hiranandi Hospital, when the investigation officer in the case during the hearing on Friday told the court that the nature of the case was “serious” and thus custodial interrogation of the two was required in the case. After observing that the nature of the matter was “serious”, Mr Khwaja ruled out pre-arrest bail for the two applicants.

Advocate Brian D’Lima, appearing for the two doctors, informed the court that both Shetty and Sewlikar were full-time doctors and not liable to examine the validity of the documents.

Mr D’Lima further argued that Brijkishor Jaiswal — the alleged kidney recipient in the case — was given a bail; so on the same grounds, Shetty and Sewlikar too were entitled to bail. However, the court pointed out that the case of Jaiswal was different as he was a patient and on dialysis. Further, Mr D’Lima told the court the papers that later turned out to be forged were given before a scrutiny committee. So, it was not the job of the doctors to interview the parties.

The investigation officer, however, said the two had failed to follow procedures laid down by the Transplantation of Human Organs Act. During court proceedings it was also revealed that Sewlikar who was summoned to give a statement at the Powai police station did not turn up.
