Jaidev Thackeray to be cross-examined on July 18

Justice Gautam S. Patel on Monday fixed July 18 for calling Jaidev, the estranged son of late Shiv Sena supremo Bal Thackeray, into the witness box to be examined in the suit. The judge said that the court proceedings in respect to the suit would be held on a daily basis in July.
Jaidev Thackeray had filed the suit challenging his father’s will of December 13, 2011, in which the late Sena chief had not left a farthing for him. Disputing the will, he alleged his father was of unsound mind and that Uddhav had influenced him.
The suit was filed after Bal Thackeray’s death in November 2012. Though Jaidev Thackeray had came to HC on April 18 to record his evidence, his testimony could not be recorded as his brother’s lawyers told the court they were informed that Jaidev Thackeray would not be available on Monday and hence they were not ready to cross-examine him. Following this, the judge had posted the matter for fixing date for examining Jaidev Thackeray on June 20.
In the past, the court had asked the brothers to settle the dispute amicably, but they failed to resolve it. Also, during the hearing Jaidev Thackeray’s lawyer had once stated before the court that her client was ready to settle the matter.
The court has till now examined witnesses Flanian D’Souza (who had drafted the impugned will), Dr Jalil Parkar (who treated Bal Thackeray) and Sena leader Anil Parab.
Mr D’Souza told the court that the late Sena chief had made multiple wills, in all of which the beneficiaries remained the same, but the assets willed to each beneficiary kept changing. He had prepared and executed his first will in 1997, and thereafter around eight to nine wills were executed, until the final one in 2011.
