Hrithik case: Notice sought for US agency

The Mumbai police has filed an application before a local court, seeking issuance of notice to US-based agency handling the email id created by Bollywood actor Hrithik Roshan.

The Mumbai police has filed an application before a local court, seeking issuance of notice to US-based agency handling the email id created by Bollywood actor Hrithik Roshan.

Pennsylvania-based company, Mail and Media Inc., runs email.com, where users can create their email ids. The police wrote to the company, seeking information about an ID ‘hroshan.email.com’ which was allegedly created by an impostor of the actor and also used to communicate with his fans. The application submitted by the cyber police, stated that the cyber cell had, on March 18, sent a letter to the Chief Technical Officer of Mail and Media Inc. asking for more information about the account. The CTO had in his reply to the letter asked them to contact the company's legal department.

According to the cyber cell, on March 31, they sent a letter to the company’s legal department which asked them to submit a subpoena document from the court. The reply allegedly stated, “We require subpoena from a court to release such account information. If you are able to provide such document, please address it as follows.”

Following this, the cyber cell filed an application before the metropolitan magistrate on April 18 requesting the court to issue a notice to the company under Section 91 of the Criminal Procedure Code (CrPC). They wanted the notice from the court directing the company to produce the said information.

“If the court does not issue the notice, then the police will not be able to probe the complaint further due to lack of information,” the application filed by the cyber crime cell said. Since over a month now, Hrithik and Kangana have been involved in an online fight regarding the said email id and have also sent legal notices to each other. Kangana who has been named a witness in the FIR filed by Hrithik will be recording her statement with the cyber police on April 30.
