High court dissatisfied with CBI report on Adarsh flats

For the second time, the Bombay high court expressed dissatisfaction over the report submitted by the CBI in connection with its investigation into benami flats in the scam-tainted Adarsh cooperative housing society in south Mumbai. The court said that the report was silent on points specifically raised by it on the last date of hearing.

A division bench of Justice Abhay Oka and Justice Amjad Sayed was hearing a PIL filed by Pravin Wategaokar, seeking direction for the CBI to disclose names of two heavyweights who dealt with the Adarsh files and allegedly obtained benami flats.

Earlier on September 2, the court had refused to accept a report submitted by CBI and said that the agency had not applied its mind in respect of issues raised in the PIL.

“We are not satisfied with this report. It is silent on very specific queries raised by us and the petition on the last hearing,” said Justice Oka, and asked the Joint Director of CBI to remain present in the court.

The bench said that on September 2, the court had asked this officer to remain present in court but instead of him, the agency’s DIG was present on Wednesday.

“We expect him to appear before us on the next date of hearing,” said the bench and posted the matter for further hearing on October 5.

The bench also asked the additional solicitor general (ASG) to appear before it at the next hearing.
