The family of Sandeep Gadoli, a gangster who was killed in an encounter in suburban Mumbai by Gurgaon police earlier this month, has moved the Bombay high court seeking directions for his re-post mortem.

Gadoli’s family has moved the court through advocate Tanveer Nizam and Yusuf Khan and the court has allowed them to make amendment in their petition and make state of Haryana as respondent and also add a request to direct the state to conduct post mortem on Gadoli’s body again.

The court has now posted this matter on February 29, to hear arguments from the petitioner’s side.

Earlier on the application of the gangster’s family, the court had directed the state to register an FIR against the police team, which was involved in the encounter. The family has alleged that the encounter was staged and it was a case of cold-blooded murder.

The contention of petitioner is that they doubt the post mortem conducted earlier and hence they want another post mortem and the injuries could prove if the encounter was staged or not.

Gadoli’s body has been lying at the morgue in JJ Hospital since February 7, when he was shot dead at a hotel in Andheri by eight police officers, while his family — Gadoli’s brother Kuldeep Singh and his sister Sudesh — has refused to collect his body stating that unless the erring cops are booked, they will not accept his body.

However the policemen from Gurgaon had challenged the high court order in the Supreme Court and the apex Court had stayed high court’s order to register an FIR. In the meantime an SIT is conducting inquiry into Gadoli’s encounter. The Supreme Court had noted that the high court had passed the order without hearing the pleadings of Gurgaon Police and sent the case back to the HC for taking a fresh look at the matter by hearing the Haryana police.

The petitioner would also be seeking the pathology report of the skin tissues. The contention of petitioner is that the high court should look personally into the CCTV images of the crime scene and should also look into the statement of the staff of the hotel.
