The CBI on Monday informed the special MCOCA court in high security Arthur Road Jail that eight more cases registered against deported gangster Chhota Rajan have been transferred to this court.
The murder case of veteran trade union leader Datta Samant is among the eight cases transferred to the CBI so far. The CBI, however, has not taken any decision on taking Rajan into custody in these cases.
When special judge S.S. Adkar asked the CBI what decision it had taken on the application made by Rajan’s lawyer in which he requested the investigative agency to take Rajan into custody in other cases also, the CBI told the court that it had to re-register FIRs in all the cases, which is time consuming and hence it would reply to this application later. This was opposed by Rajan’s lawyer, stating reference to a Supreme Court judgment that it is only a formality for an internal CBI procedure.
The judge was not satisfied with the CBI’s argument and said re-registering case is merely a formality and it could not be a hurdle in taking a decision on taking Rajan into custody. He also asked Rajan’s lawyer to bring the copy of the apex court judgment that supports his contention.
The judge also reprimanded the Central agency for taking too long for appointing a public prosecutor for the J. Dey murder case. Following this, the court was shown copy of a letter written to the Central government requesting it to issue a notification for appointing a public prosecutor for this case.
The investigating officer, through a report informed judge Adkar that further investigation into the Dey murder case was in progress and it would be completed as early as possible. After hearing arguments, the judge posted the hearing for newly transferred eight cases on March 17 and the Dey murder case on March 28.
