The Mumbai police on Tuesday informed the Bombay high court that the Mumbai commissioner of police has framed certain guidelines that are supposed to be observed during raids in hotels so that right of privacy of any person is not breached.
Khar resident Sumeer Sabharwal has filed this petition terming the raids “illegal, intrusive and unconstitutional” and sought action against police officials involved in the case.
Government pleader J .P. Yagnik through an affidavit informed this to the division bench of Justice Abhay S. Oka and Justice Amjad A. Sayed while the court was hearing petition claiming that the actions of the police conducting raid in hotels in Malwani, Malad was moral policing, and illegal.
The government filed the affidavit in response to a high court order issued on March 10 this year, in which the authorities were directed to frame guidelines for conducting raids on hotels.
According to the affidavit, raids have to be carried out only with the approval of deputy commissioners of police of the relevant zone.
