Court rejects Ankit Tiwari’s discharge plea

In a setback to playback singer Ankit Tiwari, a special women’s court in Mumbai on Wednesday rejected the application in which he was seeking discharge from the rape case.
Special judge Anju S. Shende said, “The application is rejected.” When advocate Mahesh Vaswani requested the order copy, the judge said that it would be made available to him in two to three days.
A married women has alleged that Tiwari, of Aashiqui 2 fame, had raped her while his brother Ankur had threatened her on knife point. Following this, both were arrested in 2014 and released on bail thereafter.
Tiwari had sought discharge from the case on the ground that there was no rape and even if FIR is taken as it is, no case of rape is made out because there is ambiguity. During arguments, it was pointed out to court the allegation that Tiwari forced the complainant to consume a “hard drink” was false because, as per the complaint, Tiwari was invited as a guest to the complainant’s house for a birthday party and when a drink was offered to Tiwari, he asked the host (the complainant) to have the same. According to the applicant, though she had initially refused to have that drink, after he insisted she drank it but that does not mean he forced her to have a hard drink because it is not the case that Tiwari had brought something with him, and complainant was well aware of what she was serving guests. It was also argued that it was Tiwari’s first visit to the complainant’s house.
