Chintan Upadhyay’s flat plea hearing on February 2

The Borivali matropolitan magistrate court will hear the arguments on Chintan Upadhyay’s plea to seal his Juhu flat that he shared with his deceased wife Hema, on February 2.

The Borivali matropolitan magistrate court will hear the arguments on Chintan Upadhyay’s plea to seal his Juhu flat that he shared with his deceased wife Hema, on February 2.

On January 25, Chintan had appealed to seal the flat and Hema’s studio. Later, the court ordered the investigation officer and public prosecutor to submit their recommendations on it. On February 2, the court will hear the arguments from both the prosecution and the defense. After this, on February 8, Chintan along with other four accused will be produced in the court, including the alleged minor accused.

The application for sealing the house of Santa Cruz and studio of Andheri was filed after Chintan’s friends feared that since the flat is accessible to Hema’s relatives, there are chances that they would plant some alleged evidence to incriminate Chintan.

In its written reply, the prosecution has informed the court that, the flat has nothing to do with the murder. As the murder took place in Kandivali, while the couple’s apartment is in Santa Cruz. So, the flat is neither a crime spot nor is it the place where criminal conspiracy took place so there is no need to seal either the flat or the studio.

A senior official from the investigating team, under anonymity said that the house was already checked by them, and officials have not recovered any evidence from it yet. “In this case we have no problem in keeping the flat open to the families of either accused or victim,” said the official.

Earlier Hema’s family had also raised questions over the plea, being concerned about the future of Hema’s dogs once the house is sealed.
