CBI not relying on Shyamwar Rai’s statement

The CBI on Tuesday indirectly informed the special court that it was not relying upon confessional statement of Indrani Mukerjea’s former driver and co-accused Shyamwar Rai in the sensational Sheena Bora murder case.

Sanjeev Khanna, former husband and co-accused in the murder case, had moved an application through his lawyer Shreyansh Mithare seeking the copy of a confessional statement given by Rai.

Replying on this application, the CBI on Tuesday informed the court that all the documents and evidence on which the investigating agency was relying upon had been included in the chargesheet and Rai’s statement was not part of it. According to the CBI, “A copy of relied-upon documents and statements of witnesses have been supplied to the accused.” None of the defence witnesses in this case have received Rai’s confessional statement and hence now it is considered that the CBI would not rely upon it during the trial.

It was because of Rai that the Sheena Bora murder case came to light. The Mumbai police had arrested Rai in an illegal arms case and during investigation he told the police about Sheena’s murder.

Later, the police exhumed the remains of a body from Raigad forest and claimed that digital superimposition of the profile of Sheena matched with the skull recovered from the forest. During his judicial custody, Rai apparently gave a confessional statement to the CBI but officially it never accepted that he had given a confession. Indrani and her husband Peter were also arrested in connection with the case and are in judicial custody.
