Taking into consideration the larger public interest, the Bombay high court on Monday vacated the stay that it had imposed last year, and granted permission to Kalyan-Dombivali Municipal Corporation (KDMC) to grant permission to new residential and commercial plans.
The lawyer on behalf of KDMC on Monday informed the division bench headed by Justice A.V. Mohta that steps were being taken to implement the high court order to solve the garbage disposal problem in Kalyan-Dombivali. After hearing his submissions, the bench expressed its satisfaction and said as efforts were being made to solve the garbage disposal problem, the stay granted on new constructions has been vacated.
The HC in April last year had directed the KDMC not to grant permission to any new constructions till further directions from the court on account of its failure to create civic facilities to dispose garbage. The court said that the BMC failed to create civic facilities for garbage and was allowing more housing projects in its jurisdiction resulting in generation of even more garbage.
While imposing a stay on new constructions, the court had said KDMC was causing health, hygiene, environmental and other problems and the state should issue appropriate directions to the KDMC to solve the garbage disposal problem and the Maharashtra Pollution Control Board should take penal action against the civic body for failing to do its obligatory duty.
