The Bombay high court, while deciding an appeal filed seeking to quash an FIR registered against an assistant engineer of MSEDC on the charge of abetment to suicide, held that to attract provision of abetment of suicide, there must be specific allegation that the accused had instigated the deceased to kill himself or herself.
The accused Kishore Shinde (43), an assistant engineer with Maharashtra State Electricity Distribution Company Ltd (MSEDC) was facing the charge of driving Dilip Magar, a junior technician, to commit suicide. A case was registered against Shinde after Magar committed suicide on April 8, 2014. Magar’s suicide note said he (Magar) was greatly mentally disturbed by the death of his friend and colleague, one S.B. Bhamgar, about a month earlier.
The accused and two others, seniors to the two deceased persons at work, were arrested after Magar’s suicide note said they allegedly harassed him and his friend over work.
