The Bombay high court on Tuesday refused to grant any relief to GTL Infrastructure and asked it to first pay the liabilities in terms of service tax to the concerned municipal corporations and then file an appeal seeking reduction in the amount charged from it.
The petitioner has a dispute over payment of one year’s service tax that runs into more than Rs 30 lakh to approximately 15 different municipal corporations in Maharashtra, including Murud, Kolhapur, Sangli, Manmad and Yeola etc.
Petitioner’s lawyer told the division bench headed by Justice Abhay Oka that the charges levied by the civic bodies are too high and the court should grant ad-interim relief to it and reduce the amount.
The bench however said that it could understand if some individual or a small company seeking such relief but it is surprised that a company doing business of mobile phone towers has approached the court seeking relief. The judges asked GTL to first pay 100 per cent of liabilities and then file appeal, seeking relief.
The company’s lawyer told the court that it is re-structuring its work and requested the court to grant ad-interim relief. The bench however asked it to pay the amount to all municipal corporations by March 28 and then file an appeal.
