The Bombay high court on Thursday allowed the Mumbai Education Trust (MET), run by Nationalist Congress Party leader Chhagan Bhujbal’s family, to withdraw its petition challenging the BMC’s decision to take back the open ground that it had been allotted for maintenance on adoption basis.

The counsel on behalf of MET informed the division bench headed by Justice Abhay S. Oka that the petitioner wants to withdraw the petition as it wants to make a representation before the concern authority.

Education and Welfare Trust, which is taking care of a ground in Nagpada has also challenged the decision taken by the civic body and its petition is pending before the court.

MET had approached the court against the Brihanmumbai Municipal Corporation decision to take back the open ground from it. MET had been allowed to adopt General Arunkumar Vaidya Kridangan at Bandra Reclamation, but the agreement had expired.

Following the chief minister’s direction to take back all municipal plots where agreements had expired, the BMC issued notices seeking repossession of 36 grounds. This included the ground at Bandra Reclamation.

The petition was mentioned before the court on Wednesday, at that time the judges had remarked that the organisations were holding on to the land on the basis of expired agreements but indicated that more time could be given to hand the plots back to the BMC and asked the civic body how long it would take to complete the repossession of open spaces.

This petition was supposed to be heard on Thursday but the court was informed that the petitioner wants to withdraw the petition.
