Former underworld don Arun Gawli on Monday was granted parole by the Nagpur bench of Bombay high court on grounds that he needed to be by the side of his ailing wife who is to undergo an operation on October 25. The bench in September had rejected Gawli’s application for parole saying it would allow him the same when the date of his wife’s operation was fixed. Gawli first applied for parole to the divisional commissioner on grounds that he wanted to visit his sick wife.
Following rejection of his plea, Gawli filed a writ in the high court, which too rejected his application on grounds that the divisional commissioner’s refusal was based on suggestions by Mumbai police that Gawli’s return to his residence in Dagdi Chawl would create a law and order problem.
The court however adopted a humane stand and said it would consider the former gangster’s application for parole when the date of his wife’s operation was finalised.
Accordingly, a division bench of Justices B.P. Dharmadhikari and A.S. Chandurkar of the Nagpur bench of Bombay high court on Monday allowed Gawli parole from October 21 to November 2 and issued orders to the divisional commissioner and jail superintendent to comply.
Gawli has been lodged in Nagpur Central Prison following his conviction in the murder of Shiv Sena leader Kamlakar Jamsandekar last year.
