Authority provides relief to 22 home buyers

Mumbai: In a recent judgement, MahaRERA provided relief to 22 home buyers who had booked flats in the residential project of JVPD properties. Due to delay in possession, the authority directed the developer to refund the payment to all the complainants.

The home buyers had booked flat in the developer’s ‘Bhagtani Serenity’ project located in Kurla. The developer did not give possession as mentioned in the advertisement which was published at the time of booking, thus as per section 12 of ReRa act, the authority ordered the developer to refund the booking amount with 10 per cent interest from the date of payment till they are refunded.  

According to the order, the complainants/home buyers had booked flats in the year of 2013/14, as per the advertisement, they were promised to deliver the flats within 42 months after obtaining the Commencement Certificate. However, till now the home buyers did not get any possession.  “The respondents (Developers) have issued a letter on July 24, 2017 declaring that they would not proceed ahead with the project and asked the allottees either to collect their amount or to give consent for accommodating them in respondents another project,” reads the order.
