HC admits Purohit’s appeal challenging applicability of UAPA provisions in case

Mumbai: The Bombay high court Friday refused to grant a stay on the 2008 Malegaon bomb blast case pending an appeal filed by Lt. Col. Prasad Purohit, an accused in the case.

Col. Purohit has filed an appeal in the high court, challenging the applicability of provisions of the Unlawful Activities Prevention Act (UAPA) in the case. The HC has posted the appeal for hearing on October 29.

Col. Purohit’s petition could not be heard on Thursday as one of the judges presiding over the bench supposed to hear his appeal was absent.

Purohit’s lawyer Shrikant Shivde on Friday mentioned the petition before a division bench of Justice S.S. Shinde and Justice A.S. Gadkari and requested them to grant a stay on the hearing of the Malegaon bomb blast case till his appeal was decided.

However, the bench refused to grant any stay referring to its own and the Supreme Court orders to expedite the trial and said it would hear the appeal Monday.
