Eatery moves court against ‘adamant’ BMC

On Tuesday, Tamboly informed the court that the inspection team had issued them a 12 days notice.

Mumbai: The Bombay high court has directed the Brihan-mumbai Municipal Corporation (BMC) to hear the application of Oye Kake, a restaurant in Worli that was sealed on January 10 due to violation of fire safety norms. The petitioner said that even though they had removed the objectionable items and got a clearance from the civic fire and health officer, the corporation was not removing the seal, due to which they were facing losses.  

A division bench of justices A.S. Oka and P.N. Deshmukh was hearing the petition filed by the restaurant through advocate Karl Tamboly, regarding the adamant attitude of the BMC in not unsealing the restaurant even after they had removed a tandoor and two burners that were installed without proper permission. 

On Tuesday, Tamboly informed the court that  the inspection team had issued them a 12 days notice. However, before the expiry of the period, the eatery was sealed. 

Responding to the allegations, senior advocate Anil Sakhare for the BMC said that they would send an officer to check the compliance after which the seal would be removed. The matter has been posted for Thursday.
