State restrained from acting against businessman

Mumbai: The Bombay high court has restrained the state from taking coercive action against a city-based businessman Shehzad Hemani after the Interpol issued red and yellow corner notices against him recently.

The Interpol issued the notices following a complaint filed by Hemani’s wife, who is in Netherlands.

She had alleged that last year that he brought her daughter Insiya to India without her permission. Acting the wife’s request, the Dutch government has asked India to send back the daughter.

The court passed the restraining order after Hemani’s counsel informed the court that they were awaiting extradition papers and would decide on the course of action only after receiving the papers and if the state acted upon the Interpol’s notices, Hemani would not be able to respond to the extradition notice.

The Bombay high Court recently had granted relief to Shehzad Hemani, a Bandra businessman who brought his daughter to India from Netherland without his wife’s permission.

The Bombay high court directed the Maharashtra government not to take any coercive action against ShehzadHemani until June 12.
