Since Upadhyay did not take objection on the reason mentioned, the court dismissed this petition.

Mumbai: The special NIA court on Wednesday dismissed a petition filed by retired Major Ramesh Upadhyay, an accused in 2008 Malegaon bomb blast case.

The petition asked for an inquiry under section 340 and for lodging complaint against those who conveyed altered order of court to the Taloja jail authorities that caused his co-accused, Lt Col Prasad Purohit, to land in jail hospital instead of jail barrack.

The judge cited the reason for dismissing the application saying that action will be taken against the culprit by administration, as the wrong doer must be a court staff. Since Upadhyay did not take objection on the reason mentioned, the court dismissed this petition.
