19-year-old gets one-day jail sentence for brawl

Mumbai: Taking a lenient view after a 19-year old admitted to be part of a group that got into a fight last month, a Kurla magistrate’s court reduced his jail sentence of a month to one day.

The boy said that he was the only earning member of the family and worked as a delivery boy for a private firm, and regretted getting into the fight. His fine was also reduced to Rs 50 from Rs 100, keeping in mind his economic status.

He had been booked for offences under section 160 of the Indian penal code (fighting in public).

According to the first information report filed by the Kurla police station, Ravi Ghadge (19) and Saybo Ghadge (24), both cousin brothers, got into a fight with Ritesh Nakka and Amitchandra Jaiswal in the wee hours of April 1 outside Kalpana Talkies at 2.45 am. The ruckus was broken up by a police van patrolling in the area and the quartet was taken into custody and an offence of affray under section 160 of the IPC was registered against them.

When produced in front of the magistrate Ashish Ayachit who ordered the case to be tried, Ravi pleaded guilty to the offence. He also refused legal aid that was offered by the court. Following this, the magistrate passed the judgement, which read, “The accused voluntarily pleaded guilty. He submits that he is poor and having income hand to mouth. Therefore, he prays for leniency while awarding the sentence.”
