Bombay HC grants bail to assailants on grounds of parity

One of the four assailants also died in the cross firing.

Mumbai: The Bombay high court has granted bail to Sherbahadur Singh, who was arrested for attempting to kill Arwind Walekar, former Shiv Sena Ambernath unit chief in November 2011. Mr Walekar was injured, and one of his bodyguard died after four persons had opened fire at Shiv Sena's office in Ambernath. One of the four assailants also died in the cross firing.

According to the prosecution, Mr Walekar visited Shiv Sena's office near railway station on November 23, 2011, and around four assailants barged into the party's office and started firing. Mr Walekar managed to hide behind his desk and suffered minor injures but one of his bodyguards Shyam Sundar Yadav died on the spot.

Considering that the other accused, who are also having a criminal record and were absconding, have been granted bail in the case, Justice Prakash Deu Naik gave bail to Sherbahadur Singh on the ground of parity.

The Shivaji Nagar police in Ambernath claimed that it had cracked the case with the arrest of Pandharinath Waringe, a corporator from Shiv Sena. Around two years after the incident, the police arrested Sherbahadur Singh and after recording the statement of witnesses, claimed that he was one of the assailants.

Sherbahadur Singh's lawyer Ganesh Gole contended that one accused is absconding and nine others have been granted bail. He informed the court that applicant is the only accused who is yet to granted bail. He also argued that other accused are facing similar charges to Sher-bahadur Singh.
