Pay Rs 26 lakh to realtor: RERA to buyer

As per the order, the buyer will get 45 days to make the payment.

Mumbai: The Maharashtra Real Estate Regulatory Authority (RERA) has ordered a home buyer to pay a whopping Rs 26 lakh to a realtor in Andheri. The amount is the balance payment which the buyer was supposed to pay Nisar Realtors and was dragging his feet on. As per the order, the buyer will get 45 days to make the payment.

The complaint was regarding an apartment booked by Nifor Warsi and Mohemmed Shaikh in Rajal Classic, a project of Nisar Realtors in Andheri. According to the realtors, the buyers failed to pay the requisite balance amount as per terms of the registered agreement in spite of repeated reminders. The order copy states that the buyers had paid only Rs 22 lakh out of the total consideration of Rs Rs 5,371,000 in the registered agreement for sale. Hence, the realtors approached RERA to direct the buyers to make complete payment along with interest.

However, since the project is incomplete, RERA objected to the demand for complete payment before handing over possession of the apartment. Instead, the authority ordered the buyers to make a payment of Rs 26 lakh within 45 days of the order. According to the order, if the buyers fail to make payment within the stipulated time, they will be liable to pay interest to the realtors till the actual date of payment.

Meanwhile, the authority has also ordered the realtors to give possession to the buyers before December 2018.
