Mumbai: A Mumbai sessions court on Friday granted pre-arrest bail to diamond merchant Bharat Shah and his son Rajiv. The father and son have been booked for allegedly threatening a police officer, who arrested Shah’s grandson Yash for allegedly assaulting police.

Additional sessions judge D.S. Deshmukh granted anticipatory bail to Shah and his son Rajiv, and asked them to appear before the police every Monday until the chargesheet is filed. The court further directed the police that they should be released on a bail-bond of `25,000 if arrested.

The duo claimed in their application that they were falsely implicated in the case by the officer. They also contended that they had visited the police station after receiving a phone call from the police at around 4 am, informing them about Yash’s arrest.

The duo reached the police station at around 4.30 am. The family members and relatives were made to stand outside the police station and hence, there was no question of them having abused or assaulted the complainant.

Shah said that they had a recording of their conversation with the complainant, which showed that the family was politely speaking to him while he was being rude.

The police arrested three people, including Shah’s grandson Yash, following a brawl at a south Mumbai pub in the early hours of November 23.

The police claimed that on the intervening night of November 22 and 23, the complainant police officer Anup Dange was on night duty at the Gamdevi police station. After leaving for area surveillance at around 12.45 am, he found that the bar ‘Dirty Buns Sobo’ owned by Jeetu Navlani was open. Dange allegedly tried to intimidate the owner by using names of several high-ranking officers and asked him to shut the bar immediately.

Soon after, police mobile vans were called and patrons of the bar were asked to leave. While the police team was vacating the patrons, the complainant heard some commotion on the ground floor. On arriving, he saw a group of some youth arguing with the officers.

Dange claimed that among the lot, Yash was the most aggressive and he also allegedly slapped, punched and tore shoulder strip of the uniform of a constable. When they were being hauled in the police van, Navlani allegedly intervened and stopped the complainant from arresting other accused and helped them escape. However, Yash was caught and taken to the police station.

In the bail plea, Shah has contended that the officer is a habitual complainant of similar offences and wanted to display powers vested in him.
