Mumbai-based firm’s tax case records stolen

New Delhi: Noida Income tax commissioner has lodged a police complaint alleging that the records of a Mumbai-based private firm were stolen in October 2003 from the office of deputy commissioner of Income tax, circle 7(1) at CR building, IP Estate Delhi.

The commissioner alleged that the two IRS officials, who were the lawful custodian of these records, then, were involved in the theft.   The complainant was the immediate controlling superior as Additional Commissioner of Income Tax, Range-7 during in October 2003.

SK Srivastava, income tax commissioner of Noida, said in his complaint that he is reporting theft of cases records of a private firm for assessment year 1997-98 from the office of deputy commissioner of income tax.

The documents of the property in question were stolen by the two IRS officials in collusion with unknown accomplices. Involvement of others employees, directors and shareholders of said company is not known as yet but cannot be ruled out. However, there is no direct evidence of involvement of any person other than these two IRS officials, he said.

“Both IRS officials have strong motives to steal the case records of the said company as between them they had committed grave illegalities in that case to defraud the public exchequer of Rs 50 crores,” said Mr Srivastava in his police complaint.

In his FIR, he said that he issued formal orders to one of the IRS official to act strictly as per law. On receiving formal orders, the official rejected the application of the said  firm, which meant that both the accused didn’t gety the expected bribes.

“Because of constant demands for bribe by one of the accused, I was uncomfortable working with him and sought a transfer. I was finally transferred in November 2003,” Mr Srivastava said.
