New Delhi: Leader of Opposition in Delhi Assembly Vijender Gupta on Thursday said that Arvind Kejriwal government, which had welcomed the Supreme Court judgment on Wednesday is again on the path of confrontation with the Centre and L-G within 24 hours.

Mr Gupta alleged that the AAP government has again started threatening and intimidating the government officers.

Mr Gupta advised that Kejriwal government should have faith in constitutional provisions and work in harmony with L-G in the interest of people of Delhi.

“If the Aam Aadmi Party (AAP) government feels that the judgment given by the Supreme Court is being violated, why are they afraid of filing a contempt petition in Supreme Court. The Kejriwal government should not mislead people on the judgement given by the SC,” Mr Gupta said.

According to Mr Gupta, the Supreme Court is silent on the notification dated May 21, 2015 issued by the Central government and has not set it aside and it stands as on date.

“The powers conferred on L-G under Article 239AA of the Constitution are operative. Services and ACB still come under the L-G. The Supreme Court has only interpreted the provisions of Article 239AA. In the light of this interpretation, these cases will now be placed and heard by the regular bouble bench of the Supreme Court.”

“Till the bench gives its judgement, the present position with regard to Services and ACB will hold. The Supreme Court has clearly mentioned in paragraph 278 of its judgment — the reference is answered accordingly. Matters be placed before appropriate regular bench,” Mr Gupta added.

The BJP senior leader alleged that the drama enacted by Mr Kejriwal and his Cabinet colleagues at the L-G’s office was only a tactic to exert pressure to demand full state status for Delhi.

The SC in its judgment has stated that New Delhi cannot be granted the status of a state.
