Chief Justice of India T.S. Thakur’s meltdown during a meeting of chief ministers and chief justices in the Prime Minister’s presence did more to convey the immense pressure under which the judiciary functions than what many media reports could. While the President cautioned the judiciary against judicial activism, his own stamp on the imposition of President’s Rule required the judiciary to step in. Therefore, the judiciary’s activism is a result of the executive’s violations of constitutional provisions. It is wrong to accuse the judiciary of over-reach and time we took Justice Thakur’s tears seriously.
