The Supreme Court, while upholding the constitutional validity of the criminal laws on defamation, said the right to reputation is an important aspect of the fundamental right to life and personal liberty and cannot be “crucified” at the altar of freedom of speech. This goes against the observations of the UN Human Rights Committee, which says defamation laws must be crafted with care to ensure they do not stifle free speech. It seems our legislators and our judges need to shake off archaic beliefs to get a new perspective on our legal codes.
