Pakistan’s Supreme Court on Friday annulled an order of the special court about the addition of a co-accused in the treason case against former military ruler Pervez Musharraf

The top court accepted an appeal filed by its former Chief Justice Abdul Hameed Dogar against implicating him in the trial.

A three-member bench overruled the order passed on November 21, 2014, by a special trial court regarding the nomination of Mr Dogar as co-accused in the case.

The special trial had ordered authorities to include Mr Dogar, former law minister Zahid Hamid and former Prime Minister Shaukat Aziz as co-accused in the case.

The bench noted the high court or the special court did not have the prerogative to order the nomination of co-accused in the treason case. Discretion in this regard rests with the federation, it said.

The order added that the federation only considered Mr Musharraf responsible for the imposition of emergency on November 3, 2007, which led to the confinement of a number of top court judges in their houses and the sacking of over 100 judges, including then Chief Justice Iftikhar Mohammed Chaudhry.

The apex court also ordered that the trial against Mr Musharraf should be completed at the earliest.

A special tribunal headed by Justice Faisal Arab had directed the Federal Investigation Agency in November to investigate and submit a report on the role of Mr Aziz, Mr Dogar and others in the proclamation of emergency.

Meanwhile, Mr Musharraf has sought the Supreme Court’s permission to go abroad for medical treatment.
