Petitioner advocate Ashwini Upadhyaya said the prevailing education system is discriminatory in nature and depends upon a child’s social, economic, religious and cultural background. It is against our fundamental right and inconsistent with our declaration: “To constitute India into socialist, secular, democratic, republic as the present system does not promote Socialism and Secularism in its true form and spirit.
He said Article 21A of the Constitution — Right to Education — one of the important fundamental rights, cannot be made available on the basis of a child’s social, economic and cultural background. The PIL said that the Right to Education envisages not only free and compulsory but also uniform education, having common syllabus and curriculum for all children from the age of six to 14 years.
It said a uniform education system is necessary to secure social, economic and political justice, which would develop equality in all forms.
Further value-based uniform education having common syllabus and curriculum is essential for eradication of corruption, crime, terrorism, casteism, communalism and radicalism and would be a major step in achieving gender justice.
The petitioner pointed out that the top 10 honest countries of the world — Finland, Denmark, New Zealand, Norway, Canada, Singapore, Australia, Germany, Britain and Japan — and other countries implemented value-based uniform education for all children. He sought a direction to the Centre and all states to bring about a change in the national school curriculum in the interest of children.
