Observing that the new law passed by Parliament must ensure a credible mechanism for intra and inter-country adoption of children, the Supreme Court on Monday disposed of a PIL filed in 2012 seeking a law for adoption. A three-judge Bench of Chief Justice T.S. Thakur and Justices R. Banumathi and Uday Lalit asked the Centre to expeditiously frame guidelines and rules under the Juvenile Justice (Care and Protection of Children) Act, 2015 to facilitate adoption of children. Earlier, additional solicitor-general Pinky Anand informed the court that to streamline adoption procedures for orphan, abandoned and surrendered children, the existing Central Adoption Resource Authority (CARA) has been given the status of a statutory body to enable it to perform its function more effectively. The Act provides for adoption and punishments for not complying with the laid down procedure. The Bench expressed satisfaction that it has taken over three decades for Parliament to enact a law on adoption in 1984 and said the ultimate object was to ensure the welfare of children.
