No interim relief for disqualified MLAs: Supreme Court

The Supreme Court on Wednesday refused to grant immediate relief to the nine Uttarakhand ML-As who were disqualified by the Speaker to participate in the Assembly session beginning on July 21.

The Supreme Court on Wednesday refused to grant immediate relief to the nine Uttarakhand ML-As who were disqualified by the Speaker to participate in the Assembly session beginning on July 21.

The MLAs referred to the recent apex court judgment in the Arunachal Pradesh case in support of their petition and argued that they cannot be disqualified by a Speaker who was himself facing resolution for removal. The MLAs sought a direction to stay their disqualification and to attend the Assembly. Alternatively, they sought a direction to restrain the Speaker from deciding on the resolution for his removal.

The SC bench refused to stay the disqualification. The bench also made it clear that the court cannot direct the Speaker as to what agenda he should follow in the Assembly. However, it passed a brief order that if the resolution is moved and any decision is taken, it will be subject to the result of the special leave petition challenging the disqualification of nine MLAs. The Bench posted the SLP for final hearing on July 27.
