Wrap-up: SC hearing on triple talaq ends, verdict reserved

The Supreme Court on Thursday asked Muslim bodies how can a practice like triple talaq be a matter of “faith” when they have been asserting that it is “patriarchal”, “bad in theology” and “sinful”.

The Constitution bench also reserved its verdict on a clutch of pleas challenging the constitutional validity of triple talaq after hearing parties including the Centre, the All India Muslim Personal Law Board, the All India Muslim Women Personal Law Board and various others for six days in summer vacation. This is how the case unfolded ever since its hearing started:

May 11: SC says it would determine whether the practice of triple talaq was fundamental to Islam as Centre makes it clear that such a form of divorce was against gender justice.

May 12: SC observes that triple talaq is the “worst” and “not a desirable” form of dissolution of marriage.

May 15: Centre tells SC that a new law to regulate marriage and divorce among the Muslim community would be brought, if all forms of divorce including triple talaq are struck down by the SC.

May 16: AIMPLB in SC equates the issue of triple talaq with the belief that Lord Rama was born in Ayodhya and said that these were matters of faith and cannot be tested on grounds of constitutional morality.
