BJP leader urges PM Modi on judges’ retirement

Judiciary is over-burdened and rendered ineffective with unnecessary litigation, delayed procedures & indiscriminate application of writ jurisdiction.

New Delhi: BJP Spokesperson and advocate Ashwini Kumar Upadhyaya has requested the Prime Minister Narendra Modi that his government takes appropriate steps to increase retirement age of Judicial Officers of Subordinate Courts and Judges of high courts and Supreme Court to 70 years, as it is essential to reduce pendency of cases from 15 to 3 years.

In a letter written to Mr. Modi, the advocate said there are more than three crore cases pending in courts, across the country which are just lingering along and not reaching their logical conclusion due to three reasons: Lack of judicial infrastructure i.e. lacks of district courts, staff etc., Archaic laws and Incompetent, inexperienced and unaccountable Public Prosecutors, Standing Councils and Government Advocates.

He said the right to speedy justice guaranteed under the Article 21 of the Constitution is not safeguarded. Judiciary is over-burdened and rendered ineffective with unnecessary litigation, delayed procedures and indiscriminate application of writ jurisdiction. Failure of justice system is manifesting in abnormal delays in litigation.
