Kapil, Irrfan get HC reprieve in 'unauthorised' flat construction case

The Bombay high court on Thursday extended relief already granted to comedian Kapil Sharma by a civil court.

Mumbai: The Bombay high court on Thursday extended relief already granted to comedian Kapil Sharma by a civil court and also granted relief to actor Irrfan Khan in connection with an alleged illegal construction in their residential flats.

The court has also asked both of them to maintain status quo and not make any structural changes in their premises. When the BMC lawyer complained to the court that after getting relief from civil court Kapil was carrying out further construction, the court warned Kapil's lawyer that getting relief from civil court does not mean he can carry on extending the structure.

Kapil's lawyer told the court that petitioner is not making any structural changes but he is getting work on his furniture done. The court has posted this matter for hearing after two weeks as BMC sought time to file its reply.

Kapil has also challenged BMC's notice issued under section 53 of MRTP Act (for demolition of illegal structure) saying that BMC had already issued notice under section 351 of BMC Act and that matter is already pending before the civil court so BMC is not justified in issuing another notice for same allegation.
