A Delhi court has awarded life imprisonment to a you-th and also imposed a fine of Rs 10,000 on him for stoning a 25-year-old man to death in his sleep because the victim had refused to offer him a seat where he (the accused) wanted to sleep at New Delhi Railway Station’s platform.
The accused, Santosh, through his counsel, had contended that it was a case of culpable homicide and not murder. He said that he did not know the deceased before the incident and hit him with a stone in a fit of rage following an argument. But the court rejected his contention saying he hit on the head of the deceased with a stone several times knowing that he would die.
“Medical reports confirm that the deceased was hit on his vital parts with the stone. The manner in whi-ch he was attacked was ve-ry gruesome. It proves that this is not a matter of culpable homicide but murder,” the court noted.
It noted that the prosecution had successfully pro-ved that the accused committed the murder of the deceased.
