BJP leader Subramanian Swamy on Thursday approached lieutenant-governor Najeeb Jung seeking sanction to prosecute chief minister Arvind Kejriwal under the Prevention of Corruption Act, alleging that in his first tenure as the chief minister, he had helped the AAP to receive donation from a private firm in lieu of illegally favouring it.

In a letter to Mr Jung, Dr Swamy also sought prosecution of deputy chief minister Manish Sisodia, claiming that as the city’s finance minister in the first AAP government he had also favoured the private firm that also was a VAT defaulter. There was no reaction from the Delhi government to the allegations made by Dr Swamy.

The BJP leader’s letter said that during his first tenure as the chief minister, Mr Kejriwal and his then finance minister Manish Sisodia had illegally favoured M/s SKN Associates Ltd. He also alleged the company’s name figured in a list of value-added tax defaulters that was released just 10 days before Mr Kejriwal had assumed office on December 28, 2013.

Dr Swamy alleged that Mr Kejriwal and Mr Sisodia, instead of trying to recover the dues from the company for the state exchequer, started seeking donations from the tax defaulter for the AAP. Claiming that four subsidiary companies of SKN Associates had paid a total of Rs 2 crore to the AAP, Dr Swamy alleged the firm was given various contracts, including supply of electrical equipment, air-conditioning and LPG and CNG materials.

“From my investigation, I find that after coming to power for the first time, (Mr) Kejriwal and then finance minister Sisodia started milking these defaulters, including this SKN Associates Limited. Officers disgusted with this corruption and working in the Delhi government inform me that instead of the duo heeding their constitutional duty to collect taxes for the exchequer — (Mr) Kejriwal and (Mr) Sisodia started collecting money from these defaulters.”

This is prima facie a misuse of office and misappropriation of public money and receiving quid pro quo in lieu of favour by Mr Kejriwal and Mr Sisodia for VAT defaulter/ evader, he claimed. “This comes under Sec 13 (1)(D) of Prevention of Corruption Act,” Dr Swamy alleged.
