A bench of Justice B.D. Ahmed directed the ESIC Hospital at Basai Darapur to restart the process of tender for housekeeping and facility management services before January 31 while permitting the successful bidder to participate in the same. “The present tender shall be offered for re tender on or before January 31, 2015 after modifying the conditions and the scope of work suitably.

“The petitioner (M/s Vishakha Facility Management Pvt Ltd) as well as the respondent no. 2 (M/s Vayudoot Security Services Pvt. Ltd) and other bidders who satisfy the tender conditions shall be permitted to participate in the fresh tender,” the court said.

The court order came on a plea filed by the firm, which deals in management and housekeeping solution, alleging that the rules have been violated during the process and the tender was arbitrarily awarded to Vayudoot Security, which was blacklisted and debarred by the ESIC Hospital itself in November 2013.

The petition filed through advocate Asutosh Lohia and R.K. Sahni submitted that only three companies were found to be eligible for participating in the financial bid.

However, the ESIC Hospital did not inform the company about the time and schedule of the financial bid and the petitioner was informed that the same shall be communicated to them later on, “but later clandestinely and secretly favour was given to the successful bidder”, the counsel alleged.

Employees State Insurance Corporation (ESIC) is a multidimensional social security system tailored to provide socio-economic protection to worker population and their dependents covered under the scheme.
